APC Loses Out As Supreme Court Restores Mutfwang As Plateau Governor

The Supreme Court overturned the Court of Appeal’s decision to remove Governor Caleb Mutfwang of Plateau State.

In a judgement on Friday, the court upheld Muftwang’s appeal, deeming it meritorious. Justice Emmanuel Agim, in the lead judgement, affirmed the election tribunal’s decision to dismiss the petition by the All Progressives Congress (APC) and its candidate, Nentawe Yilwatda.

Agim asserted that Muftwang’s qualification to contest the election was valid as the National Executive Committee (NEC) of the PDP conducted the primary election that produced him.

The court ruled that the tribunal lacked jurisdiction to hear the petition challenging Mutfwang’s nomination and sponsorship, emphasising that the APC, not being a PDP member, lacked the right to contest the selection process of its candidate.

Furthermore, the court emphasised the absence of evidence proving that the PDP disobeyed a Plateau State High Court order for fresh congresses to constitute the state executive committee of the party.
