Obasa Drags Lagos Assembly To Court, Challenges Impeachment

Former Speaker of the Lagos State House of Assembly, Mudashiru Obasa, has filed a lawsuit against the Assembly and his successor, Mojisola Meranda, contesting the legality of his removal from office.
Obasa, in a suit lodged at the Lagos State High Court, Ikeja, argues that his January 13, 2025 impeachment was unconstitutional, as it was executed while the Assembly was on recess.
The case, yet to be assigned to a judge, seeks a declaration that his removal was unlawful and in violation of legislative procedures.
Through his lawyer, Chief Afolabi Fashanu (SAN), Obasa contends that 36 lawmakers ousted him in his absence, while he was out of the country, without due process. He has urged the court to grant an accelerated hearing, limiting the defendants’ response time to seven days, with his own reply period set at three days.
“The legality of the Assembly’s current leadership must be urgently determined, as it violates the applicable laws and rules,” Obasa stated in his application.

His suit questions the interpretation of sections of the 1999 Constitution (as amended) and the Lagos State House of Assembly’s Standing Orders, maintaining that a sitting cannot be held during recess unless convened by the Speaker or with delegated authority.
Obasa, who returned to Lagos on January 25 to a rousing welcome from his supporters, insists he was not afraid of impeachment, but stressed that due process was ignored.
He further accused security agencies, led by the Lagos State Commissioner of Police, of facilitating his removal by deploying over 200 officers to his residences and the Assembly complex.
His impeachment was endorsed by more than two-thirds of the 40-member House over alleged misconduct, with Meranda making history as the first female Speaker of the Lagos Assembly.
As of now, no date has been fixed forthe court hearing.
