A’Court blocks INEC from holding Imo PDP repeat elections
The Owerri Court of Appeal has banned the Independent National Electoral Commission and the People’s Democratic Party from holding a new PDP primary for the state’s Aboh Mbaise/Ngor Okpala federal constituency.
An Abuja federal court last week had canceled the PDP’s primaries for the federal constituency of Aboh Mbaise/Ngor Okpala, which had Albert Agulanna as the winner, and ordered a new primary to be held within the next 14 days.
Judge Rita Pemu, hearing an appeal filed by Uzoma Ugochukwu against PDP, INEC, Bede Eke and Albert Agulanna, ordered that the proposed rerun of the primaries be halted pending the hearing and decision of the applicant’s appeal at the Supreme Court.
In issuing orders, the Justice said: “Accordingly, the following is hereby ordered, that the order of this honorable court dated January 20, 2023, ordering new primaries for the federal constituency of Aboh Mbaise/Ngor Okpala of Imo State, pending of the Hearing and Final Decision of the Applicant’s Appeal to the Supreme Court on the correctness of the said Order of New Primary and is hereby suspended.
“Consequently, by this order, the first and second defendants are hereby restrained from in any way enforcing the judgment of this court of January 20, 2023 through the holding of new primaries for the federal constituency of Aboh Mbaise/Ngor Okpala. .”
