Federal High Court Dismisses CODRAS’ Suit, Affirms Adron Homes’ Rights as Estate Developer

The Federal High Court in Abeokuta, Ogun State, has struck out a fundamental rights enforcement suit filed by the Registered Trustees of the City of David Residents Association (CODRA) and five of its members against Adron Homes and Properties Limited.
In Suit No. FHC/AB/FHR/58/2023, presided over by Justice Abiodun J. Adeyemi, the Applicants — Elder Gbadebo Aromolaran, Mr. Adetokunbo Adeshile, Mr. Olaolu Ayinde, Olusegun Aba Yomi Esq., and Oluwadamilare Awokoya Esq. — alleged that Adron Homes infringed on their personal liberty and freedom of association.
Delivering judgment, Justice Adeyemi held that the Applicants failed to provide credible evidence to substantiate claims that Adron Homes posed any threat or carried out acts capable of breaching their fundamental rights. The court noted there was no record of invitation, arrest, or other action attributable to the developer that could justify such allegations.
On the claim that Adron Homes proscribed CODRA or interfered with residents’ right to associate, the court clarified that while residents are entitled to form associations, the legal authority to own, manage, and administer the estate remains exclusively vested in Adron Homes as its rightful developer and manager.

Justice Adeyemi emphasised that the ruling was based strictly on facts and the law, not speculation or personal sentiment. Consequently, the suit was dismissed in its entirety for lacking merit.
Reacting to the judgment, Adron Homes described the decision as a vindication of its integrity and commitment to client satisfaction, stressing that its primary goal remains ensuring the welfare and comfort of its subscribers and residents.
The ruling, legal observers say, reaffirms the company’s position as a law-abiding, customer-oriented real estate developer while setting a significant precedent for similar disputes in the property sector.
