S’court dismisses lawsuit against Imo PDP Rep candidate

The Supreme Court on Friday rejected an appeal by the All Progressives Congress against the People’s Democratic Party against the federal constituency of Achiazu Mbaise Ezinihitte in Imo state.

The appeal was dismissed by the apex court on the grounds that APC has no legal right to interfere in the selection of PDP’s nominee.

A leader of the Imo State APC, Nnamdi Igbokwe, had filed the lawsuit against the nomination of Emeka Martins Chinedu as the PDP candidate for the federal constituency of Achiazu Mbaise Ezinihitte.

Igbokwe had been praying for a court order against the Independent National Electoral Commission not to accept or list Chinedu as a legitimate candidate.

APC argued that the PDP’s candidate returned unopposed in a primaries for the House of Representatives ticket for the February 25, 2023 National Assembly election and that the unopposed system that Emeka Martins Chinedu produced during the primaries was unknown was by law and had to be rejected by the Electoral College.

After losing the lawsuit in the Federal Supreme Court and Court of Appeals, the APC went to apex court to voice its complaint about how PDP had produced its nominee.

But the Supreme Court dismissed the appeal on the grounds that it lacked merit and ruled that the APC and Igbokwe, who were the appellants, have no business to challenge the PDP’s candidate selection process.

Judge Emmanuel Akomaye Agim ruled that APC acted as a meddlesome interloper in interfering with the PDP’s affairs and asked the parties to bear their respective court costs.
