Edo PDP crisis: Court dismisses Orbih’s lawsuit
The Supreme Court on Wednesday rejected an appeal filed by the Dan Orbih faction of the People’s Democratic Party in Edo state.
The court’s five-member panel ruled that Omorie Ogbeide-Ihama’s appeal was incapacitated because it was based on issues that did not arise from the appeals court’s ruling.
The appellants have requested the court to set aside the lower court’s decision.
They claimed the verdict contained an error of law when it did not declare them as valid PDP candidates in the elections.
But the court ruled that the appeal was unjustified.
“Any plea that does not contest the issues raised in the lower court is without jurisdiction. I judge in favor of the respondents.”
According to the ruling, to be eligible for review, an appeal must be based on issues raised in the lower court
In the judgment of Justice Centus Nweze, the court therefore rejected the appeal on the grounds of incompetence.
Prior to this, both parties had separately appealed against the judgment of the courts.
The parties to their lawsuits had asked the court to force INEC to publish their names as the duly elected candidates of the Edo State PDP for the 2023 general election.
Dissatisfied with the lower court’s verdict, the faction of the Orbih appealed the verdict to the Supreme Court.
However, a verdict was passed against him on Wednesday.
