Property Dispute: Court Adjourns For Ruling
A Gudu Upper Area Court of the Federal Capital Territory (FCT) has adjourned the hearing against a former clerk of the National Assembly, Alhaji Ataba Sani-Omolori, by his siblings to February 7 regarding their late father’s property.
Omolori was taken to the Upper Area Court for alleged inability to account for the family estate left behind by their father.
Two of his siblings, Nasir Sani-Omolori and Buhari Sani-Omolori, who are plaintiffs in the case, want the court to give Omolori an account of the property.
The plaintiffs, through their counsel, AI Mariri, in the suit number CV/114/2022l pray that the court invite the former NASS clerk to answer for the estate of their late father, Alhaji Muhammad Sani Omolori, who was a traditional was ruler of Ebira land for 40 years.
They accused their brother, Alhaji Ataba Sani-Omolori (defendant/defendant) of selling parts of the real estate in the Maitama, Katampe and Mabushi districts of Abuja.
They are asking the court for a fair division of property among all 73 children of their deceased father.
During the proceedings on Monday, the judge, Ado Mukhtar, announced the new date for hearing the case after approval of the preliminary objections and against the preliminary objections of the plaintiffs’ counsel.
Chris Okoye, counsel for Ataba Omolori, had previously insisted that the plaintiffs do not have the locus standi (legal right) to bring the lawsuit, arguing that the proper parties to the lawsuit were not in court.
But the plaintiffs’ counsel, Abdulahi Awwal Muhammed, refuted him in his arguments during the proceedings, telling the court that his clients had not made any mistake in filing the case, saying that the court has jurisdiction to hear it as well. take.
“In Islamic law you don’t talk about jurisdiction and as expected the other party’s lawyer admitted that the court does indeed have jurisdiction and now the judge has set February 7 to rule on the case,” Muhammed said.
They told the court: “The late Alhaji Muhammad Sani Omolori died and left behind wives and 73 children, including the applicants and the 2nd defendant/defendant (Alhaji Ataba Sani Omolori), who are also Muslims.
