APC Primary: Again, Biyi Adeleye Loses Against Ogun Lawmaker, Solomon Osho, As Court Struck Out His Brief Of Argument
At the hearing, the Presiding Justice, Hon. Justice Moore Adumein struck out the Appellant’s Brief of Argument for filling out of time.
Biyi Adeleye’s Brief of Argument in support of his appeal application against Solomon Osho struck out today at the Appellant Court, Ibadan.
The Court of Appeal in Ibadan on Wednesday heard the appeal of Adebiyi Adeleye against the decision of Justice Oguntoyinbo of Federal High Court, Abeokuta which disqualified him as Candidate, and ordered the incumbent Solomon Osho as valid candidate for APC in the forthcoming 2023 House of Assembly Election for Remo North State Constituency.
At the hearing today, both parties adopted their Brief of Arguments, Affidavits, Counter Affidavit, as well as a Preliminary Objection filled by Counsels to the Respondent, Hon Solomon Osho. The Appellant, Adebiyi Adeleye was represented by Mr Adetunji Osho Esq and Mr Chukwudi Maduka Esq. However, the 1st Respondent, Osho, was represented by the trio of Mr Rasaq Okesiji, Esq, Ajibola Kaka Esq and Adepeju Adeniran Esq.
At the hearing, the Presiding Justice, Hon. Justice Moore Adumein struck out the Appellant’s Brief of Argument for filling out of time. He then adjourned for Judgement on a date to be announced.
It will be recalled that Adebiyi Adeleye was disqualified at the Court of First Instance at Abeokuta on October 6, 2022 when the Court ruled that he did not purchase Nomination and Interest Form and did not participate in the screening exercise of the Party. The Court also ruled that he neither resigned his appointment as Special Adviser to the Governor on Political Matters and that he presented a forged school certificate.
